Police have found in its preliminary investigation that the man who had come to pick the woman up that day was using his friend’s account and phone to take bookings and driving the cab in place of him. Both Arav Yadav, the man accused of rape, and his friend Joginder, whose account he was using, have been arrested.Vineet Jaiswal, SP (rural), told TOI that the legal action has been sought against the company as they have been receiving many complaints from people about possible loopholes in the Uber’s operating system.“After the recent incident of rape by an Uber driver, it was brought to our notice that many a times, people face the same problem that the rape victim had faced. The driver who comes to pick up passengers is often not the same whose number and photo is shown in the app. Taking a suo moto cognisance of the situation, an FIR has been filed against the company management under Section 336 (act endangering life or personal safety of others) of the Indian Penal Code ,” said Jaiswal.He added that the company had been warned several times in the past. “In the past too, we have arrested men who are authorised as Uber drivers and have been to jail for heinous and petty crimes. In the recent incident too, it has been found that the accused, Arav Yadav, had been to jail in Haryana for sexual harassment of a woman in his village. He, too, had been to jail in the past.“We are awaiting a copy of the FIR or any formal communication from the police or any concerned authority. After reviewing the FIR, we would like to deny any allegation raised in the press release. We have and will continue to extend our full support to investigating and other authorities,” Uber said in a statement. The company said it will “pursue all legal recourse” against both the accused and his friend.
