First FIR under new criminal law registered in Amroha

The first FIR under the Bharatiya Nyaya Sanhita, 2023, was registered in Amroha district of Uttar Pradesh. Three new criminal laws – the Bharatiya Nyaya Sanhita (BNS), the Bharatiya Nagrik Suraksha Sanhita (BNSS), and the Bharatiya Sakshya Adhiniyam (BSA), came into force from Monday onwards. The special thing is that these new laws have been implemented first in Uttar Pradesh. The first police report has been filed in UP under the new law. According to an official communiqué, the first case in Uttar Pradesh under the Bharatiya Nyaya Sanhita, which came into force from Monday, has been registered in Amroha. This case has been registered under Section 106 of the BNS. According to information received from the police, this case has been registered against Rajveer alias Rajju and Bhoop Singh alias Golu for negligence leading to death. An FIR was registered against them at 9:51 am in Rehra police station of Amroha. Sanjay Singh of village Dhakiya Khadar claimed that his father Jagpal died due to the current flowing in the electric wire installed in the field of the accused. Jagpal died of electric shock while working in the field at 6:30 am on Monday. At the same time, after the implementation of the new law, the second FIR has been registered in the Baradari police station of Bareilly in the state. The case has been registered under Section 97 of the BNS. Earlier, this case was registered under Section 369 of the Indian Penal Code, for kidnapping of a child below 10 years of age. It may be mentioned that the Indian Penal Code has been replaced with the Bharatiya Nyaya Sanhita, the Criminal Procedure Code with Nagarik Suraksha Sanhita and the Indian Evidence Act with Bharatiya Sakshya Adhiniyam. Bharatiya Nyaya Sanhita has 358 sections (instead of 511 sections of IPC). A total of 20 new crimes have been added to the BNS, and the imprisonment sentence has been increased for 33 crimes. The amount of fine has been increased in 83 crimes and mandatory minimum punishment has been introduced in 23 crimes. The penalty of community service has been introduced in six crimes and 19 sections have been repealed or removed in the law. Bharatiya Nagrik Suraksha Sanhita has 531 sections (in place of 484 sections of CrPC). A total of 177 provisions have been changed in the BNSS and nine new sections as well as 39 new sub-sections have been added to it. The BNSS has added 44 new provisions and clarifications. Timelines have been added to 35 sections and audio-video provision has been added at 35 places. A total of 14 sections have been repealed and removed in the BNSS. Bharatiya Sakshya Adhiniyam will have 170 provisions instead of the original 167 provisions in the Indian Evidence Act, and a total of 24 provisions have been changed. Two new provisions and six sub- provisions have been added and six provisions have been repealed or deleted in the Bharatiya Sakshya Adhiniyam.
