Kanpur: Sub-divisional magistrate (SDM) Sadar Sanjay Kumar has registered a case against a popular online food delivery company for supplying “tasted and less in quantity food articles” on Thursday.The SDM took cognizance and registered the case under Section 133 of CrPC and issued notice to chief executive officer of the company.According to details of the case, the SDM had ordered six pieces of ‘ras malai’ sweet through online booking from a shop on Birhana Road on February 3. A delivery man of the online company delivered the article at his residence.The SDM observed that packing of the sweet was not intact and there were only four pieces of sweet in place of six that were ordered. Since the packing was not intact and it was clear that it had been broken, he asked his servant to throw the sweet in an apprehension that some injurious substance might be mixed. Thereafter he registered an online complaint.Since there was no action, the SDM himself went to the sweet shop on Thursday morning and asked to show the CCTV footage. He thereafter contacted the sales officer of the online company and summoned the deliveryman, a resident of Shukla Ganj in Unnao. He confessed that he had eaten two pieces of sweet as he was hungry and admitted to his fault in writing.The SDM first handed him over to the police, but later released him on humanitarian ground but registered a case against the online company.The company’s sales officer Jaspreet claimed that he had retrenched the deliveryman for his act.The Section 133 of CrPC has a provision that if a district magistrate or a sub-divisional magistrate or any other executive magistrate considers that the conduct of any trade or occupation or keeping of any good or merchandise is injurious to health or physical comfort of the community, and that in consequence such trade or occupation should be prohibited or regulated or such good or merchandise should be removed or the keeping thereof, he could take cognizance and initiate action.
