Jaipur Development Authority to challenge HC order on master plan

An official source at JDA said, “There are nearly 210-225 colonies that fall in the ecological zone as per the city’s Master Plan-2025. We would seek relief in the apex court.”The government had constituted a high-power committee to examine the order of the court on a PIL by Gulab Kothari. The court had given 35 directions in its order on January 12, 2017. Many people are living in these colonies and waiting for regularisation for past several years. But the land use of areas reserved in the master plans have been changed by the committee constituted by the state government under Rajasthan Municipalities (Change in Land Use) Rules, 2000, based on the recommendations made by the local bodies.

JAIPUR: To provide relief to thousands of plot owners who are residing in the unregularised colonies, the Jaipur Development Authority (JDA) has decided to file a Special Leave Petition ( SLP ) in the Supreme Court, challenging the high court order on master plan.The civic body will challenge the court order which includes, the abolition of compounding provision for violation of building bylaws, restoration of ecological zone, and restoring the land use change of the facility areas as per master plan. An official source at JDA said, “There are nearly 210-225 colonies that fall in the ecological zone as per the city’s Master Plan-2025. Many people are living in these colonies and waiting for regularisation for past several years. We would seek relief in the apex court.”The government had constituted a high-power committee to examine the order of the court on a PIL by Gulab Kothari. The court had given 35 directions in its order on January 12, 2017. The decision of the government is based on the recommendation of the high-power committee.For the same, a meeting was also organised at the state-government level, which was chaired by principal secretary UDH Bhaskar Sawant, was attended by chief town planner R K Vijayvargiya, officials of the UDH, revenue and legal department.The court asked the government to abhor the practice of regularizing illegal constructions by paying a penalty for illegal constructions (compounding). The court had also come down heavily on the government for regularizing buildings on ecological zones and at facility areas.The government is of the view that the implementation of the order of the court involves large-scale demolition. Master plans have been prepared for Jodhpur, Kota, Bikaner, Ajmer and Udaipur cities, in which, certain places have been reserved as 'Green Belt Areas' (also known as peripheral control belt) for public amenities. But the land use of areas reserved in the master plans have been changed by the committee constituted by the state government under Rajasthan Municipalities (Change in Land Use) Rules, 2000, based on the recommendations made by the local bodies.
